Welcome to Rekt Eddie’s LLC and its subsidiaries, representatives, officers, members, or directors (collectively “Rekt Eddies” or “we”). By accessing or using our website, or purchasing any of our products (collectively the “Service”), you agree to be bound by the following terms and conditions (“Terms of Service”). If you do not agree with any part of these terms, please refrain from using our Service.

IMPORTANT: PLEASE BE ADVISED THAT THIS AGREEMENT CONTAINS PROVISIONS THAT GOVERN HOW CLAIMS BETWEEN YOU AND REKT EDDIES CAN BE BROUGHT, INCLUDING THE ARBITRATION AGREEMENT (SEE SECTION 12 BELOW). PLEASE REVIEW THE ARBITRATION AGREEMENT BELOW CAREFULLY, AS IT REQUIRES YOU TO RESOLVE ALL DISPUTES WITH REKT EDDIES ON AN INDIVIDUAL BASIS AND, WITH LIMITED EXCEPTIONS, THROUGH FINAL AND BINDING ARBITRATION (AS DESCRIBED IN SECTION 12 BELOW). BY ENTERING INTO THIS AGREEMENT, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND ALL OF THE TERMS OF THIS AGREEMENT AND HAVE TAKEN TIME TO CONSIDER THE CONSEQUENCES OF THIS IMPORTANT DECISION.

1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you and Rekt Eddie’s LLC. By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind the organization to these Terms.

2. Description of Service

Rekt Eddie’s LLC is a company that provides a variety of hemp-derived cannabis-related products, including THC and CBD products, as permitted by law. The Service is intended for use by individuals who are of legal age (21 years or older) to purchase and consume hemp-derived cannabis products in their jurisdiction. The Service is provided on an “as- is” and “as available” basis. Rekt Eddie’s LLC reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without notice. Rekt Eddies may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.

3. User Conduct

1. Age and Legality: The Service is intended for users who are of legal age (21 years or older) to purchase and consume hemp-derived cannabis products in their jurisdiction. It is your responsibility to ensure that you comply with all applicable laws and regulations regarding the use of hemp-derived cannabis products in your location.
2. Prohibited Activities: When using our Service, you agree not to engage in any of the following activities:
   • Violating any laws or regulations related to hemp-derived cannabis use or distribution.
   • Uploading, transmitting, or distributing any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
   • Impersonating any person or entity or falsely representing your affiliation with any person or entity.
   • Interfering with the proper functioning of the Service or bypassing any measures we may use to prevent or restrict access to the Service.
   • Copy, stealing, infringing upon, or in any way interfering with the intellectual property rights of Rekt Eddies or any other person or entity.

4. Compliance with Hemp-Derived Cannabis Laws

Rekt Eddie’s LLC operates in compliance with all applicable laws and regulations. It is your responsibility to ensure that you comply with the laws of your jurisdiction regarding the purchase, possession, and use of hemp- derived cannabis products.

5. Intellectual Property

Rekt Eddie’s LLC retains all rights, title, and interest in and to the Service, including all content, trademarks, logos, and other intellectual property owned or licensed by Rekt Eddie’s LLC. You are not permitted to use any of the intellectual property without the express written consent of Rekt Eddie’s LLC.

6. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy (/privacy/), which outlines how we collect, use, and share your personal information when you use our Service, especially regarding hemp-derived cannabis-related data.

7. Disclaimer of Warranty

To the greatest extent allowed under the law, the Service is provided “as is” and without warranties of any kind, whether express or implied. Rekt Eddie’s LLC make no representations or warranties regarding the accuracy, legality, reliability, availability, or suitability of the Service for your specific needs. We disclaim all warranties, including but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the greatest extent allowed under the law, in no event shall Rekt Eddie’s LLC be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the Service or these Terms of Service, including but not limited to hemp-derived cannabis-related issues or effects. Your sole and exclusive remedy for dissatisfaction with the Service is to stop using it.

9. Indemnification

You agree to indemnify and hold harmless Rekt Eddie’s LLC, their officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising from your use of the Service or any violation of these Terms of Service, including any hemp-derived cannabis-related claims or legal issues.

10. Changes to the Terms of Service

Rekt Eddie’s LLC reserves the right to modify or replace these Terms of Service at any time. We will notify you of any material changes through the Service or via email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms of Service.

11. Governing Law and Jurisdiction

Notwithstanding and conflicts of law analysis, you and we agree that any and all transactions between Notwithstanding and conflicts of law analysis, you and Rekt Eddies occur within the State of Minnesota. You and we agree that any and all transactions are completed within the State of Minnesota. Notwithstanding and conflicts of law analysis, these Terms of Service shall be governed by and construed in accordance with the laws of the State of Minnesota. Except as describe in Section 12 below, any dispute arising out of or relating to these Terms of Service or the use of the Service shall be subject to the exclusive jurisdiction of the courts located in Minnesota.

12. Dispute Resolution and Arbitration

1. Covered Disputes: Except as expressly provided below in Section (d), you and Rekt Eddies agree that any dispute, claim, or controversy in any way arising out of or relating to (i) these Terms and prior versions of these Terms, or the existence, breach, termination, enforcement, interpretation, scope, waiver, or validity thereof; (ii) your access to or use of the Service at any time; (iii) incidents or accidents resulting in personal injury to you or anyone else that you allege occurred in connection with your use of the Service, regardless whether the dispute, claim, or controversy occurred or accrued before or after the date you agreed to the Terms, and regardless whether you allege that the personal injury was experienced by you or anyone else; and (iv) your relationship with Rekt Eddies, will be settled by binding individual arbitration between you and Rekt Eddies, and not in a court of law. This Arbitration Agreement survives after your relationship with Rekt Eddies ends.
2. Any dispute arising out of or relating to between you and Rekt Eddies shall be settled by arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. However, this arbitration agreement does not apply to any transaction occurring outside the United States or its territories.
3. Class Action Waiver: You acknowledge and agree that any and all disputes, claims, or controversies between the parties shall be resolved only in individual arbitration. The parties expressly waive the right to have any dispute, claim, or controversy brought, heard, administered, resolved, or arbitrated as a class, collective, coordinated, consolidated, and/or representative action, and neither an arbitrator nor an arbitration provider shall have any authority to hear, arbitrate, or administer any class, collective, coordinated, consolidated, and/or representative action, or to award relief to anyone but the individual in arbitration. The parties also expressly waive the right to seek, recover, or obtain any non-individual relief. Notwithstanding anything else in this agreement, this Class Action Waiver does not prevent you or Rekt Eddies from participating in a classwide, collective, and/or representative settlement of claims.Further, if it is determined by an arbitrator that Section 11 does not apply to your claims and that the laws of California apply to your claims, then you will be entitled to pursue your claims on a representative basis and seek public injunctive relief. A determination on the application of Section 11 to your claims or any conflict of laws analysis is delegated to and must be determined by an arbitrator.

   The parties further agree that if for any reason a claim does not proceed in arbitration, this Class Action Waiver shall remain in effect, and a court may not preside over any action joining, coordinating, or consolidating the claims of multiple individuals against Rekt Eddies in a single proceeding, except that this Class Action Waiver shall not prevent you or Rekt Eddies from participating in a classwide, collective, and/or representative settlement of claims.

   If there is a final judicial determination that any portion of this Class Action Waiver is unenforceable or unlawful for any reason, (i) any class, collective, coordinated, consolidated, and/or representative claims subject to the unenforceable or unlawful portion(s) shall proceed in a court of competent jurisdiction; (ii) the portion of the Class Action Waiver that is enforceable shall be enforced in arbitration first before any claim proceeds in court; (iii) the unenforceable or unlawful portion(s) shall be severed from this Arbitration Agreement; and (iv) severance of the unenforceable or unlawful portion(s) shall have no impact whatsoever on the enforceability, applicability, or validity of the Arbitration Agreement or the arbitrability of any remaining claims asserted by you or Rekt Eddies.

4. Exceptions to Arbitration: Notwithstanding the foregoing, this Arbitration Agreement shall not require arbitration of the following claims: (i) individual claims brought in small claims court so long as the matter remains in such court and advances only on an individual basis; (ii) individual claims of sexual assault or sexual harassment occurring in connection with your use of the Service; (iii) injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights; or (iv) transactions occurring outside of the United States or its territories.Such claims may be brought and litigated in a court of competent jurisdiction by you on an individual basis only. On an individual basis means that you cannot bring such claims as a class, collective, coordinated, consolidated, mass and/or representative action against Rekt Eddies.

13. SMS and Email Messaging

By using the Service, you may have the option to receive SMS or email messages from Rekt Eddie’s LLC for order updates, promotions, and other relevant information. If you choose to opt-in for these communications, you consent to receive such messages to the phone number or email address provided by you.

1. Opt-Out: If you wish to stop receiving SMS or email messages from Rekt Eddie’s LLC, you can opt-out at any time by following the instructions provided in the message or by contacting our customer support.
2. Message and Data Rates: Standard message and data rates may apply for SMS messages, depending on your mobile carrier plan. Rekt Eddie’s is not responsible for any fees or charges incurred by you as a result of receiving SMS messages.
3. Email Communications: Rekt Eddie’s LLC may also send you promotional and informational emails. You can manage your email preferences by following the instructions provided in the email or by contacting our customer support.

14. Hemp-Derived Cannabis-Specific Notices

Rekt Eddie’s LLC will provide hemp-derived cannabis-specific notices, where required, to ensure compliance with local, state, and federal laws regarding hemp-derived cannabis products. These notices may include warnings, disclaimers, or instructions regarding the use of hemp-derived cannabis products. By using our Service, you acknowledge and agree to comply with all such notices.

15. Legal Compliance

Rekt Eddie’s LLC is committed to operating in full compliance with all applicable laws and regulations related to the sale and distribution of hemp-derived cannabis products. You, as the user, are responsible for understanding and abiding by the hemp-derived cannabis laws in your jurisdiction.

16. No Medical Advice

Any content provided on the Service, including product descriptions, educational material, and blog posts, is for informational purposes only and should not be considered medical advice. It is not intended to diagnose, treat, cure, or prevent any medical condition. Always consult with a healthcare professional before using any cannabis products, especially if you have pre-existing health conditions or are taking medication.

17. Severability

Except as provided in Section 12, if any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions shall not be affected and shall continue in full force and effect.

18. Entire Agreement

These Terms of Service constitute the entire agreement between you and Rekt Eddie’s LLC concerning the subject matter herein and supersede all prior and contemporaneous agreements, communications, and understandings, whether oral or written.
